These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Bretary ("Company," "we," "us," or "our") governing access to and use of our website, applications, and trading services (collectively, the "Platform"). By creating an account or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use the Platform. You represent that you are legally permitted to trade binary options in your country of residence and that all information provided during registration is accurate and complete.
2. User Agreement
Your account is personal and non-transferable. You agree to maintain the confidentiality of your login credentials and to notify us immediately of any unauthorized access. You are solely responsible for all activity conducted under your account.
3. Account Responsibilities
- Provide truthful identity and contact information when requested.
- Complete verification (KYC/AML) procedures as required by law.
- Maintain sufficient funds before placing trades.
- Review trade confirmations, balances, and statements regularly.
- Comply with applicable tax obligations in your jurisdiction.
4. Trading Rules
All trades placed through the Platform are subject to our published payout rates, expiry rules, and asset availability at the time of execution. Once a trade is confirmed, it generally cannot be modified or canceled except where required by law or at our sole discretion in cases of manifest error.
Market prices displayed on the Platform are indicative and may differ slightly from third-party feeds due to latency, liquidity, or technical factors. We reserve the right to reject, cancel, or adjust trades affected by pricing errors, system failures, or suspected market manipulation.
5. Deposits & Withdrawals
Deposits and withdrawals are processed according to our published payment policies. We may impose limits, fees, or additional verification for certain transactions. Processing times vary by payment method and are not guaranteed. We are not responsible for delays caused by banks, payment processors, or blockchain networks.
6. Platform Rights
We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, including assets offered, payout percentages, trading hours, and features. We may update these Terms periodically; material changes will be communicated via the Platform or email. Continued use after changes constitutes acceptance.
All intellectual property on the Platform — including software, branding, content, and design — remains our property or that of our licensors. You may not copy, reverse engineer, or redistribute any part of the Platform without written consent.
7. Prohibited Conduct
You agree not to:
- Use the Platform for fraud, money laundering, or illegal activity.
- Create multiple accounts to abuse bonuses or promotions.
- Employ automated systems, bots, or exploits without authorization.
- Manipulate prices, collude with others, or engage in abusive trading.
- Circumvent geographic restrictions or provide false location data.
- Harass staff or other users or attempt unauthorized access to systems.
8. Limitation of Liability
To the fullest extent permitted by law, Bretary shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Platform, including loss of profits, data, or trading capital. Our total liability for any claim shall not exceed the fees paid by you to us in the twelve (12) months preceding the claim, except where prohibited by applicable law.
9. Termination
You may close your account at any time subject to settlement of open positions and withdrawal of remaining balances. We may suspend or terminate your account immediately if you breach these Terms, if required by regulators, or if we reasonably suspect fraudulent or harmful activity. Upon termination, your right to access the Platform ceases, but provisions that by nature should survive (including liability limits and dispute resolution) shall remain in effect.
10. Governing Law & Disputes
These Terms shall be governed by the laws of the jurisdiction in which Bretary is incorporated, without regard to conflict-of-law principles. Disputes shall first be addressed through our internal complaints process; unresolved matters may be submitted to binding arbitration or competent courts as specified in your account agreement.
11. Contact
